1. Introduction and Agreement
These Terms and Conditions ("Terms") govern the relationship between Tallow House LLC ("Company," "we," "us," or "our") and the customer ("you," "your," or "User"). By accessing our website or purchasing our products, you engage in our “Service” and agree to be bound by these Terms, including those additional terms and conditions and policies referenced herein.
2. Product Information and Handmade Disclaimer
Handmade Nature: You acknowledge that Tallow House LLC products are handcrafted. No two items are identical. Variations in color, scent intensity, shape, and weight are inherent to the process and shall not be deemed defects.
Tallow Sourcing: We use high-quality animal fats. Due to the biological nature of tallow, seasonal changes in the animals' diets may slightly alter the consistency or natural scent of the base product.
Small Batch Production: We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction on a case-by-case basis.
3. Health, Safety, and Allergy Warning
Ingredient Disclosure: A full list of ingredients is provided on each product page and physical label. It is your responsibility to review these for potential allergens.
Patch Test Requirement: Customers should perform a patch test before using any of our products and should discontinued use if adverse reactions occur.
Medical Disclaimer: Our products are not intended to diagnose, treat, cure, or prevent any disease. Statements regarding the benefits of tallow or essential oils have not been evaluated by the FDA.
Assumption of Risk: By purchasing, you assume all risk associated with the use of the products, including but not limited to skin irritation, allergic reactions, or slippery surfaces (tubs/showers) resulting from oil-based ingredients.
4. Billing and Payment
Price Changes: Prices for our products are subject to change without notice.
Accuracy: You agree to provide current, complete, and accurate purchase and account information for all purchases. We reserve the right to refuse any order you place with us.
5. Shipping and Risk of Loss
Domestic Shipping Only: At this time, Tallow House LLC exclusively ships to addresses within the United States and its territories. We do not offer international shipping or fulfill orders destined for freight forwarding addresses intended for export.
FOB Shipping Point: All items are sold "Free on Board" (FOB) at our shipping point. This means the risk of loss and title for such items pass to you upon our delivery to the carrier (e.g., USPS, UPS, FedEx).
Delivery Issues: We are not responsible for packages marked as "Delivered" by the carrier that are subsequently lost or stolen.
Environmental Factors: Due to the natural composition of tallow-based products, Tallow House LLC is not responsible for products that melt, soften, or change texture during transit due to extreme heat or weather conditions. We recommend retrieving packages promptly upon delivery.
6. Intellectual Property
All content included on our site, such as text, graphics, logos, images, and product names (e.g., "Tallow House LLC"), is the property of the Company and protected by copyright and trademark laws. You may not reproduce or "pass off" our branding as your own.
7. Limitation of Liability and Indemnification
No Warranty: We do not guarantee that the quality of any products, services, or information purchased by you will meet your subjective expectations.
Liability Cap: To the fullest extent permitted by law, Tallow House LLC’s liability for any claim shall not exceed the purchase price of the product in question. We are not liable for any indirect, incidental, or punitive damages.
Indemnity: You agree to indemnify and hold Tallow House LLC harmless from any claim or demand made by any third party due to or arising out of your breach of these Terms.
8. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan. Any disputes arising shall be resolved exclusively in the courts of Saginaw County, Michigan.
